Aitzaz Ahsan, le président du barreau de la Cour suprême, Ali Ahmed Kurd,   et Tariq Mahmood, juge à la retraite et ancien président du barreau de la Cour suprême, trois avocats  éminents qui  étaient à la tête du mouvement de défense de l'indépendance de la justice lancé lorsque le président Moucharraf a limogé l'ancien président de la Cour suprême, le 9 mars 2007, ont été arrêtés de nouveau pour un mois supplémentaire alors qu'ils venaient d'être libérés deux jours plus tôt,  le 31 janvier 2008 après avoir été détenus en prison et assignés à leur domicile pendant quatre-vingt-dix jours.. 

Atizaz Ahsan a été libéré de sa résidence surveillée le 31 janvier, mais il a de nouveau été assigné à son domicile, à Lahore, le 2 février. Tariq Mehmood et Ali Ahmed Kurd ont été libérés le 1er février. Les dernières ordonnances de placement en résidence surveillée émises à leur encontre sont entrées en vigueur les 2 et 4 février respectivement. Tariq Mehmood est assigné à son domicile d’Islamabad, tandis qu’Ali Ahmed Kurd est retenu chez lui à Quetta.   

 
Munir A. Malik, qui est également un ancien président de l'Association du barreau de la cour suprême, a été libéré mais est en mauvaise santé. Amnesty International craint que le refus de soins médicaux spécialisés dont il avait besoin n’ait rapidement dégradé son état.
Aux termes de l’article 10 de la Constitution pakistanaise, qui a été rétablie le 15 décembre 2007, en application de la législation sur la détention provisoire, les autorités ne peuvent pas détenir des personnes pendant plus de quatre-vingt-dix jours, à moins qu’un collège de trois juges de la haute cour n’approuve leur demande de prolongation du maintien en détention.

RAPPEL : Aitzaz Ahsan, le président du barreau de la Cour suprême, Ali Ahmed Kurd, Munir Mallik et Tariq Mahmood, juge à la retraite, avaient une première fois été arrêtés immédiatement après la déclaration d’état d’urgence, le 3 novembre 2007. Ces mesures ont été prises alors que la Cour suprême s'apprêtait à se prononcer sur des requêtes remettant en question l'éligibilité du général Moucharraf à l'élection présidentielle du 6 octobre. Les avocats qui avaient présenté ces requêtes, dont Aitzaz Ahsan, président de l'Association du barreau de la Cour suprême, Ali Ahmed Kurd, Munir A. Malik et le juge à la retraite Tariq Mahmood, ont été immédiatement arrêtés.

ACTIONS REQUESTED :

Please write to the authorities of Pakistan urging them to :

1. Guarantee in all circumstances the physical and psychological integrity of Mr. Aitzaz Ahsan, Mr. Tariq Mahmood and Mr. Ali Ahmed Kurd;
2. release immediately and unconditionally Mr. Aitzaz Ahsan, Mr. Tariq Mahmood, Mr. Ali Ahmed Kurd as well as all other defenders who are currently detained, since their detention is arbitrary as it merely aims at sanctioning their human rights activities;
3. Put an end to all acts of harassment, including at the judicial level, against all human rights defenders in Pakistan;
4. Conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 6, which states that “everyone has the right, individually and in association with others: to know, seek, obtain, receive and hold information about all human rights and fundamental freedoms (...), freely to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms and to study, discuss, form and hold opinions on the observance (...) of all human rights and fundamental freedoms and, through these and other appropriate means, to draw public attention to those matters”.
5. Ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Pakistan.
