Lakshan Dias
harcelé
et menacé d’enlèvement.
Depuis le 22 février, Lakshan
Dias, un célèbre avocat des droits de l’homme au Sri Lanka Lakshan Dias, est suivi et surveillé par des
inconnus qui ont cherché à obtenir des informations sur lui auprès de son
épouse et de ses voisins.
Selon
des avocats spécialistes des droits de l’homme au Sri Lanka, des hommes à
moto et à bord d'une camionnette blanche surveillent la résidence de Lakshan Dias depuis le 22 février, et ont
questionné ses voisins et sa famille à son sujet, créant un climat de peur
et d'intimidation.
Une
personne qui s'est rendue dans le quartier et a demandé où se trouvait Lakshan Dias se serait présentée à un voisin comme un
inspecteur de police, mais l'officier responsable du poste de police de
Moratuwa, dans le district de Colombo a nié connaître un inspecteur de ce
nom. .
Entre
le 22 et le 26 Février 2013, des hommes à motos et dans des camionnettes
blanches ont été vu rodant autour de la résidence de Lakshan
Dias. White vans are widely used
for abductions in Sri Lanka and are cause for fear.
Il
a également été suivie par une camionnette
blanche, incident qui a fait l’objet d’une plainte à la police de Moratuwa,
le 25 Février 2013, sous la référence CIB-1-232/442. Mais nul ne sait si
une suite y a été donnée.
Or,
les camionnettes blanches sont usuellement utilisés pour les enlèvements au
Sri Lanka et ses confrères du Lawyer's Collective craignent qu'il ne soit victime d'une disparition forcée et de
violences physiques. .
Lakshan Dias est
un éminent avocat spécialiste des droits de l’homme. Il a défendu les
victimes de violations des droits de l'homme dans les applications relatives
aux droits fondamentaux devant la Cour suprême et des juridictions
inférieures. He has also been an
active and leading member of Lawyers for Democracy and the Lawyers
Collective, which in late 2012 and early 2013 led the campaigner against
the impeachment of the Chief Justice of Sri Lanka [1][1] . Il a
également été un membre actif et de premier plan de Juristes pour la
Démocratie et le collectif des avocats, qui à la fin 2012 et au début 2013
a conduit la campagne contre la destitution du juge en chef (CJ) , le président de la Cour suprême sri-lankaise, du Sri
Lanka.
Lawyers
Collective a demandé instamment au gouvernement d'enquêter sur ces
incidents et de veiller à ce que les avocats, qui se sont dressés contre la
destitution illégale de la plus haute autorité judiciaire du pays, ne
seront soumis à aucune intimidation.
Depuis
janvier, The Observatory expresses
its deep concern about those acts of surveillance and intimidation, which
seem to be aimed at sanctioning Mr.Depuis janvier d'autres avocats
qui ont participé à la campagne contre la destitution du juge en chef de la
43 ème Sri Lanka a
également confrontée actes de surveillance, tentative d'enlèvement, de
fusillades et des lettres de menaces.
Plusieurs autres avocats ont reçu des
menaces de mort parce qu'ils avaient participé à des manifestations prônant
l'indépendance du pouvoir judiciaire. Parmi eux, l'ancien président de
l'Association du Barreau du Sri Lanka, Romesh de
Silva, l'un des avocats le plus élevé dans le Sri Lanka, qui a dirigé
l'équipe juridique qui a représenté le Dr Shirani
Bandaranaike (CJ) dans tous les forums durant la
saga de destitution.
Mais aussi, Jayampathi Wickremarathna
PC, qui était auparavant consultant senior au ministère des Affaires
constitutionnelles, et a soumis une requête à la Cour d'appel l'opposition
à la mise en accusation, MA Sumanthiran, député
de l'Alliance nationale tamoule (TNA), et membre actif de l'équipe
juridique qui a représenté le CJ, et enfin, JC Weliamuna,
un éminent avocat, membre actif de l'Assistance-avocats du collectif, qui
est également un ancien directeur de la branche sri-lankaise de Transparency International.
Des
disparitions forcées présumées continuent d'être signalées au Sri Lanka.
L'utilisation de camionnettes blanches est souvent associée à des
arrestations qui s'apparentent à des enlèvements orchestrés par les
autorités sri-lankaises. La torture en garde à vue et la détention
arbitraire, y compris dans des lieux tenus secret ou des centres de
détention officieux, sont aussi des pratiques qui ont été dénoncées autour
de ces arrestations.

attacks
Lakshan Dias, a well-known human
rights lawyer in Sri Lanka, has come under strict surveillance making his life vulnerable for
physical attacks. He had also been followed by a white van, which incident has
been reported to the Moratuwa Police on 25th
February 2013, under reference CIB-1- 232/442.
From February 22 to
February 26, 2013, men in motorcycles and white van have been loitering
around Lakshan Dias’ residence. White vans are
widely used for abductions in Sri Lanka and are cause for fear. Some of
these went away without speaking to anyone. But others spoke to Lakshan Dias’ wife and neighbours and asked about him
without giving specific details.
One of the persons who visited the
neighbourhood and asked about Lakshan Dias
identified himself as an Inspector of Police to a neighbour, but later on,
the Officer in Charge of the police station to where Dias lodged a
complaint denied knowing an Inspector by that name.
Lakshan Dias a well
known human rights lawyer and activist, He was an active and leading member of
Lawyers for Democracy and the Lawyers Collective, which in late 2012 and
early 2013 led the campaigner against the impeachment of the Chief Justice
of Sri Lanka.
Since January, several lawyers, senior and
junior, have come under threats. Among them :Romesh de Silva PC,
one of the topmost lawyers in Sri Lanka, a former president of the Bar
Association of Sri Lanka, who led the legal team which represented Dr. Shirani Bandaranayaka (CJ) in all forums during the impeachment
saga.
Jayampathi Wickremarathna
PC, who was formerly the
senior consultant in the Constitutional Affairs Ministry is a well known constitutional lawyer and submitted a
petition to the Court of Appeal opposing the impeachment, MA Sumanthiran is an MP from the Tamil National
Alliance (TNA), and an active member of the legal team which represented
the CJ. He spoke during the parliamentary debate on the impeachment,
opposing the impeachment and voted against it.
JC Weliamuna is a prominent lawyer, an active
member of the Lawyer's Collective and an internationally known human rights
campaigner. He is also a former director of the Sri Lankan branch of
Transparency International.
We remind the Government of its
constitutional duty to protect and respect the citizen's right to dissent
and to engage in critical governance activities. The lawyer's struggle was
a discharge of their constitutional duty to protect independence of
judiciary, which they will continue to do, despite threats.
The Lawyers' Collective therefore urges the Government to investigate into
these incidents and ensure that the Lawyers, who have stood up against the
illegal impeachment of the highest judicial officer of the Country, will
not be subjected to any further intimidation.Dias has appeared for victims of human
rights violations in fundamental rights applications before the Supreme
Court and lower courts.
