On June 17, Sapiyat Magomedova, 31, a Dagestani lawyer, was beaten up by
police in Khasavyurt in the northern part of the republic.
Sapiyat Magomedova is a member of the
Khasavyurt Bar "A. S. Omarov and Partners", known for position
of principle of its members in defence of citizens' legitimate rights and
interests. She has sent four applications to the European Court of Human
Rights about violations of her clients' rights by detectives from the
Khasavyurt prosecutor’s office.Omarov and Partners frequently takes on
cases relating to abductions, torture and extrajudicial executions in
Dagestan. As a lawyer who has often defended citizens against the
authorities, Magomedova had herself been threatened repeatedly even prior
to the latest incident .
She was trying to secure permission from an investigator
to visit her client, who had been arrested that same day, and the
investigator reportedly ordered the policemen “to throw [the lawyer] out”
of the police building. Sapiyat Magomedova suffered a number of serious
injuries and was taken to the hospital, but the doctors refused to
provide the results of the official medical examination, which could be
used as evidence against the police.
As reported by Sapiyat's colleague Adilgerei
Omarov, chairman of the Bar "Omarov and Partners", Police
pressure on Sapiyat Magomedova might be explained by the circumstances
surrounding her client, Malika Evtemirova, who had been detained by
militiamen at the post located at entrance to Khasavyurt. When learning
about detention, on June 17 she came to the GOVD to meet her client
Malika Evtomirova, who had been detained earlier on that very day.
At about 4:00 p.m., after having presented
her ID, the lawyer passed into the GOVD building through the check post
and went upstairs to inspector Zakir Stambulov to ask for access to
Evtomirova.
According to Omarov, Magomedova has a
warrant: earlier she had already worked with her client. In spite of it,
the inspector rejected her access to the client, called a militia group
and ordered them: "Throw her out of here."
After that, as Magomedova's colleague
reported, four OMON (Special Militia) fighters of the GOVD of Khasavyurt
began violently beating her with fists and feet. Militia boss Shamil
Temigereev ran out to the noise and ordered "to throw her out".
The lawyer was dragged, in the state of unconsciousness, to the check
post and left there. Sapiyat had her gold chain lost, her mobile phone
broken.
She was brought by an ambulance to the
Khasavyurt city hospital, where she was without consciousness till
evening; however, the forensic medical expert refused to examine her.
Employees of the Khasavyurt GOVD and forensic
medical experts were inaccessible for comments.
The health condition of lawyer Sapiyat
Magomedovaremains grave. Her
relatives, who feared that she would lack qualified medical help while in
Khasavyurt, insisted on her transfer to the Republic's Clinical Hospital
in Makhachkala.
According to the relatives Sapiyat cannot
even move by herself. She is in consciousness, but practically cannot
speak and eat normally.
In november 2009, lawyer Sapiyat Magomedova,
was accused byan inspector for
especially important cases of the Investigatory Committee at the
Prosecutor's Office of Dagestan, of insulting him with swear words and
tired in the court precinct No. 106 of Khasavyurt.
