On 18 September 2009, Ricardo Lagunes
Gasca attended a meeting, in his capacity as a lawyer with Frayba, in the
cooperative Ejido Jotola, in the municipality of Chilon. The meeting
related to a legal action to defend residents of San Sebastian Bachajon
who have been jailed.
At approximately 12.00 pm, Ricardo Lagunes
Gasca left the meeting in one of Frayba´s vehicles, however approximately
40 metres ahead the road was closed off with large rocks and a tree
trunk, forcing him to stop. Ricardo Lagunes Gasca and the vehicle were
then ambushed by a group of approximately sixty people armed with sticks,
rocks, machetes and guns.
The attackers are allegedly members of the
pro-government paramilitary group, Organización para la Defensa de los
Derechos Indígenas y Campesinos – OPDDIC (Organization for the Defense of
the Rights of Indigenous and Campesinos). The group succeeded in forcing
Ricardo Lagunes Gasca out of the Frayba van, beat him and took the keys
to the vehicle.
Seeing that Ricardo Lagunes Gasca was
being attacked, residents of Jotola and San Sebastian Bachajon came to
his aid and distracted the attackers. Ricardo Lagunes Gasca managed to
flee, leaving all his belongings in the Frayba van.
After the intervention of the residents of
Jotola and San Sebastian Bachajon, it is alleged that the armed group
fired their guns, resulting in a resident of San Sebastian Bachajon
receiving a bullet wound in the thigh of his left leg. After the gun
attack, the residents of Jotola and San Sebastian Bachajon fled the
OPDDIC group. The OPDDIC group then reportedly surrounded the residents’
homes and threatened to enter them. They also temporarily took over the
main meeting hall of San Sebastian Bachajon.

Por favor
escribir a las autoridades mexicanas urgiéndolas a:
i. Tomar las
medidas más adecuadas para garantizar la seguridad y la integridad física
y psicológica del Sr. Ricardo Lagunes Gasca y de sus familiares, de los
demás miembros del Centro de Derechos Humanos “Fray Bartolomé de Las
Casas”, así como de todos los defensores de derechos humanos en Chiapas;
ii. Realizar
una investigación inmediata, independiente, exhaustiva e imparcial en
torno a los hechos arriba denunciados, con el fin de identificar a los
responsables, llevarlos ante un tribunal competente, independiente e
imparcial y aplicarles las sanciones penales y/o administrativas
previstas por la ley;
iii. Poner
fin a todo tipo de hostigamiento en contra de los defensores de derechos
humanos en México;
iv. Asegurar
la aplicación de lo dispuesto por la Declaración sobre los Defensores de
los Derechos Humanos, adoptada por la Asamblea general de la ONU el 9 de
diciembre de 1998, en particular en lo referente a la protección del
derecho de toda persona “individual o colectivamente, a promover y
procurar la protección y realización de los derechos humanos y las
libertades fundamentales en los planos nacional e internacional” (Art.1)
y a “garantizar la protección [...] de toda persona, individual y
colectivamente, frente a toda violencia, amenaza, represalia,
discriminación, negativa de hecho o de derecho, presión o cualquier otra
acción arbitraria resultante del ejercicio legítimo de los derechos
mencionados en la [...] Declaración” (Art. 12.2);
v. De manera
general, conformar sus acciones a lo dispuesto por los Pactos y
Convenciones Internacionales de Derechos Humanos ratificados por México.

I am deeply concerned for the
physical and psychological integrity of Ricardo Lagunes Gasca and all
human rights defenders in Chiapas. I believe that this latest attack by
pro-government paramilitary forces on a member of Frayba forms part of a
sustained strategy of repression of human rights defenders in this region
of Mexico.
I urge the authorities in Mexico to:
1.Carry out an immediate, thorough
and impartial investigation into the ambush and armed attack on Ricardo
Lagunes Gasca, with a view to publishing the results and bringing those
responsible to justice in accordance with international standards;
2. Guarantee the security and
physical and psychological integrity of Ricardo Lagunes Gasca and all
members of Frayba;
3. Ensure that all human rights
defenders in Mexico, carrying out their legitimate work in the defence of
human rights, are able to operate free of restrictions and reprisals.
